Ponderosa Lhasa Apso Ranch Health Guarantee

 

Buyer's Responsibilities:

You must have puppy examined by a licensed veterinarian within 72 hours of date of sale.  The failure to do so will void this guarantee.

All deposits are non-refundable.

Failure to keep your new puppy on the same type of food could result in diarrhea, loss of appetite or both of these symptoms.  We feed Victor’s Superior Premium Chicken and Brown Rice Pet Food and have provided you with 3-4 days of formula in a zip lock pouch.

With a new puppy come extra responsibilities. Failure to follow these guidelines could put your puppy in serious danger.

Buyer understands the puppy has received proper vaccinations and all deworming’s are up to date as of the date the buyer took possession of the puppy.  The buyer understands they must continue to have the puppy seen by a licensed veterinarian at the proper intervals throughout the first year of life to maintain the dog’s health and this guarantee.  Buyer agrees to keep the dog up to date on all vaccinations recommended by their veterinarian during the first year.  Vaccinations must adhere to your veterinarian’s recommend schedule. 

If the buyer does not continue veterinarian care at the necessary intervals during the first year of life to ensure the dog’s health, including necessary vaccinations, the health guarantee is Null and Void.

A DETAILED RECORD OF YOUR PUPPY'S HEALTH & VACCINATIONS IS INCLUDED IN YOUR SALES AGREEMENT AND PUPPY PACK.  PLEASE TAKE THIS WITH YOU TO YOUR FIRST VISIT TO YOUR VET TO MAKE SURE YOUR VET DOES NOT GIVE A VACCINATION THAT HAS ALREADY BEEN GIVEN!

We know the health of the puppy is a major concern for anyone considering purchasing one of our puppies.  Every puppy is given a thorough health exam by our veterinarian Dr. Shuler at the Shuler Veterinary Clinic located 5092 US-78 Saint George, Sc 29477.  Ph# (843) 563-3092

What is NOT covered by the Health Guarantee:

This guarantee does not cover what in some breeds is considered normal:  the condition Cryptorchidism (undescended testicle), cherry eye, distichiasis, ectopic, “loose” hips, elongated soft palate, teeth alignment, bite alignment, anything cosmetic, coat texture/color, size of dog, training abilities, temperament or any skin condition food/allergies. 

Seller is not responsible to replace a puppy for any of the following reasons:  poisoning ingested, biting of electrical cords, consumption of prescription or non-prescription drugs, antifreeze, toxic plants, vitamins or ingestion of any substance toxic to animals including food poisoning, lawn chemicals (which can cause seizures in puppies), eating of bones, neglect, idiopathic seizures or abuse.

This guarantee does not cover disorders caused by environmental factors, including, but not limited to:  allergies, thyroid dysfunction, demodectic mange, idiopathic seizures and other autoimmune disorders that are not covered by this guarantee.

There will be no replacement puppy if a death was the result of abuse, neglect or accident. I.e. Lawn chemicals which can cause seizures in puppies.

There is no guarantee that the buyer will be able to show or breed the puppy regardless of show or breeding potentials.

There is no guarantee given as to its fitness for any special purpose outside of companionship.

The parentage/pedigree is correct to the best of the seller’s knowledge; The buyer agrees not to hold the seller responsible in any manner in the unlikely event that a problem might arise from the puppy’s parentage/pedigree.

Submissive wetting, and/or behavioral problems and house-training abilities are not covered by this guarantee.  Responsibility of the buyer is to train and socialize the puppy and this responsibility starts the moment the puppy is in your possession.

If buyers or sellers veterinarian determines that sickness or death was caused by a hypoglycemic attack brought on by lack of proper care then no replacement puppy will be given.

Any physical problem, which is or could be the result of injury, is not covered under this guarantee.

Puppies commonly have benign heart murmurs, which disappear by roughly 6 months of age. These puppy murmurs typically are not cause for concern and are not covered.

An umbilical hernia is a most common type of hernia found in puppies. In the case of umbilical hernias, a portion of fat or internal organ protrudes through an incompletely closed umbilical ring. Umbilical hernias may be present at birth or may be acquired. The most common means of acquiring an umbilical hernia is a result of the umbilical cord being severed too close to the abdominal wall or the mother dog consistently gnawing and pulling on the cord. In most cases, umbilical hernias are small and reduce as the puppy grows. Generally, by the time the puppy is six months old the umbilical hernia will shrink and disappear on its own. This type of hernia is very common and usually not a health risk therefore, the seller is not responsible for an umbilical hernia that may exist or appear later on the puppy, though at the time of sale if the puppy does have an umbilical hernia, we will reduce the purchase price of the puppy and instruction will be given about this.   Buyer assumes responsibility for any hernias and for all cost involved with umbilical hernias.

Seller will not be responsible for any medical expenses/vet bills incurred.  Buyer is aware that owning a puppy means trips to the veterinarian and understands that he/she will be responsible for all payments.

No guarantee is given for any kind of worm, coccidia, or giardia, kennel cough, pneumonia, hypoglycemia and other stress related illnesses that may occur in the puppy from the stress of the moved or flight from my home and the buyer is solely responsible for any medical expenses/vet bills incurred as a result.

I understand I should not take my puppy anywhere they could come in contact with, or where unvaccinated dogs my have been until 2 weeks after his/her 4-month booster is completed as this could transmit Parvo to my puppy.  Areas of potential contact with parvo are but not limited to:  areas where dogs are walked, pet stores, parking lots, dog parks, vet clinic floors, near the feces of other dogs.  I understand that puppies could develop parvo, a deadly disease.  I understand this puppy has been vaccinated for Parvo and every measure taken to protect my puppy from this virus.  I understand that my puppy can still contract Parvo from public areas and if this puppy contracts Parvo the seller is not responsible for any medical expenses/vet bills or death of puppy resulting from said diseases.

Parasites/viruses are all too common to puppies and can be contracted from your soil or boarding facility. Your puppy has been wormed frequently from six weeks of age until your possession. It is your responsibility to continue to worm your puppy and check for parasites.  Internal flea preventatives are not acceptable and will void your guarantee. Frontline or Advantage is recommended for flea prevention.

A puppy with a genetic/congenital defect must be returned to the seller to qualify for a replacement puppy. NO REFUND, in part or in full, will be given. A returned puppy must be returned to the seller in good condition, other than the specified problem, at the buyer's expense. The owner will then qualify for a replacement puppy. Buyer is responsible for transportation costs to and from the seller on a replacement puppy. Seller will not pay or be responsible for any medical expenses/vet bills incurred in diagnosing or treating.  Moreover, if you decide to keep and treat a puppy with a genetic/cognitive defect or an ill puppy, seller will void all aspects of this contract.

This guarantee applies to the original puppy buyer only and is nontransferable to any subsequent owners of the puppy.

NO replacement puppy will be covered under this guarantee if the puppy has sired or whelped one or more puppies.

Replacement puppy will be mutually agreed upon by both parties and will be of comparable quality. It is understood that the replacement puppy may not be from the exact same parents of the original puppy.

Physical problems that are or could be the result of injury, abuse, neglect, or if the buyer fails to complete vaccinations and puppy checks by a qualified Vet, are not covered under this guarantee.

Proof of said preventative care and maintenance must be furnished upon request of breeder.

Although our puppies are bred to AKC standard, and most have excellent conformation, we can make NO guarantees of “Show Quality.”  Our main concern and objective are to raise beautiful, healthy companions. We also cannot guarantee adult size, color or temperament. While we do our best to give an accurate adult weight, there is absolutely NO GUARANTEE that the puppy will be the estimated size, or color. Coats and color may change.  This puppy has been sold as a companion animal only and this guarantee covers only that use.

There is no guarantee that the Buyer will be able to show or breed the puppy regardless of show or breeding potentials. Retained testicles and hernias are not covered under this guarantee.

What IS covered by Health guarantee:

Buyer understands that this puppy is guaranteed until one year of age against fatal life altering genetic/congenital defect which adversely affects the health of the animal. This includes severe hip dysplasia which hampers a dog’s movement and natural gait and requires surgery to correct, kidney, heart, pancreas, spine, and liver problems of a severe life-threatening nature.

All items covered under this guarantee are by replacement only. We do not give refunds.

Procedures if dog is diagnosed with a genetic or congenital defect during the first year of life.

A puppy diagnosed by a veterinarian with any serious life altering genetic or congenital defect in the first year of life will be replaced as follows:

The defect must be documented by a licensed veterinarian on or before the puppy’s first birthday.  Seller must be notified of the problem within 3 business days of the licensed veterinarian’s determination.  All veterinarian findings must be submitted and signed by a licensed Veterinarian and be sent on the Veterinarian's letterhead to the seller.

In the event of illness or genetic/congenital defect of a puppy the breeder/seller is not responsible for any medical expenses/vet bills incurred in diagnosing or treating any illness or genetic/congenital defect.

If the dog dies within this one-year time frame, the buyer will pay to have it autopsied by a licensed veterinarian to ascertain the reason.  Seller must be notified of the problem within 3 business days of the licensed veterinarian’s determination. If reason is congenital or genetic, the seller will replace the puppy.  All veterinarian findings must be submitted and signed by a licensed Veterinarian and be sent on the Veterinarian's letterhead to the seller.

In the event of death of a puppy the seller is not responsible for any medical expenses/vet bills incurred in diagnosing or treating of any illness or genetic/congenital defect.

Upon determination that the dog does qualify under the conditions of the replacement guarantee the seller will provide a replacement puppy of equivalent value.

A puppy with a qualified defect must be returned at the buyer’s expense to the seller or with the prior permission of the seller, be euthanized to qualify for a replacement puppy.  This guarantee applies to the original owner of the puppy only and is not transferable to a second party.

No replacement puppy will be given if the puppy has been euthanized without the seller’s permission.

The replacement puppy will be provided by seller out of the next available litter.  The replacement puppy will be mutually agreed upon by both parties.  It is understood and agreed that the replacement puppy may not be from the exact same parents of the original puppy.

This contract supersedes any and all previous agreements.

This contract is null and void if the terms and conditions are not fulfilled, including taking your new puppy to the vet within 72 hours.

This contract is written for the protection of the seller, the buyer, and the puppy.

To the best of the seller’s knowledge the puppy is in good health at the time of sale.

Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of South Carolina, in the county of Dorchester.  It is agreed that the place of venue shall be in Dorchester County, South Carolina.

The BREEDER guarantees the above-described puppy to be healthy at the time of the sale.

The BREEDER has given all appropriate shots for the puppy’s age and a record of this vaccination history is supplied to the BUYER.

The BREEDER has done everything possible to produce healthy sound puppies and by raising the puppies in the best way possible in regard to diet, exercise, socialization and veterinary care.

The BREEDER does not guarantee that the puppy you purchase will be a competent breeder or show quality.

The BREEDER can offer no further guarantees once the care of the puppy is no longer under their control.

The BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in the sale agreement and the Health Guarantee. Both Documents constitute the entire agreement between the BREEDER and BUYER with respect to this sale.

The BUYER agrees to have this puppy examined by a veterinarian within 72 hours of sale. If the puppy is found to be in poor health within the 72-hour time frame, then the BREEDER will replace said puppy. If there are no longer any puppies available at the time, then a replacement puppy from the next litter of equal value will be given. If the BUYER chooses not to have the puppy examined within 72 hours this contract will become null and void.

The BUYER must present to the BREEDER written verification from the veterinarian as to the illness of the puppy prior to replacement.

NO REPLACEMENT will be made until such documentation is provided. BREDEDER reserves the right to take said puppy to his/her vet for a second opinion before any replacements are made.

The BUYER agrees that all documents that were submitted to him/her at the time of sale be returned to BREEDER upon return of said puppy. If not returned BUYER will not receive replacement of puppy.

The BUYER agrees to have this puppy picked up at 8 weeks of age. Any scheduled pick up after that time period a $20 dollar a day fee will be charge as well as an $8 charge if additional vaccine is given.

The Buyer agrees to read all information provided to them in the Puppy Packet.
